The overall objective is to have in place the priority legislation that the public service requires to support effectively its service delivery agreements, as well as the sustainable development of the Turks and Caicos Islands (TCI). The purpose of this contract is to provide the technical support necessary to appraise and update the existing legislation, and where appropriate, draft new legislation.
The processes are carried out across 4 phases:
- Phase 1: Identification of Legal Framework for Review and Policy Ideals. This phase will provide an initial assessment of (i) the existing/interim framework for legislative review and (ii) the review of legislative projects to be undertaken. An Action Plan will be prepared to set-up the frame (procedure, resources and timing) for each drafting project.
- Phase 2: Research and Development of Policy Goals and Compatibility Assessment. This Phase is essential to determine the policy framework that will guide the legal review and drafting process. A Green Paper will be prepared to be used as a reference document for a wide public consultation discussing the frame and objectives of the reform. A White Paper will then be drafted with the conclusions and policy guidance from decision-makers
- Phase 3: Bill Drafting/redrafting. Based on the White Paper, the experts will draft the Bills (jointly with local drafters to facilitate on-the-job transfer of know-how) for each legislative project. In parallel, a compatibility assessment and a Regulatory Impact Assessment will be carried out to ensure that the proposed legislation will have the desired impact
- Phase 4: Technical Assistance and Capacity Building for Further Legislative Review. The project also aims at strengthening the local capacities for further review and drafting of legislation. The experts will therefore work with the local stakeholders to ensure that they have capacities to undertake any subsequent work after the Interim Administration has transferred power to the elected administration. This phase will also include activities to ensure that information related to the newly developed and adopted legislation is well understood by the population.
